TN visa (Trade NAFTA) is a temporary non-immigrant work visa for Canadian and Mexican citizens
The TN nonimmigrant classification permits qualified Canadian and Mexican citizens to seek temporary entry into the United States to engage in business activities at a professional level.
Initial admission on a TN visa is for up to 3 years (can be less depending on how long the employer states the worker’s length of stay will be), however it allows for an extension of stay. any eligible TD family member may also apply to extend their status.
There is no annual cap to TN visa status
Eligibility Requirements
- Must be a citizen of Canada or Mexico
- The profession qualifies is on the NAFTA list
- The position in the United States requires a NAFTA professional;
- You have a prearranged full-time or part-time job with a U.S. employer
- Must have the qualifications to practice in the profession in question.
Application and Authorization Process
If you are a Mexican citizen, then you are required to obtain a visa to enter the United States as a TN nonimmigrant. You should apply for a TN visa directly at a U.S. embassy or consulate in Mexico in order to obtain a TN visa stamp.
If you are a Canadian citizen, then you are not required to apply for a TN visa at a U.S. consulate. A Canadian citizen without a TN visa can apply for TN nonimmigrant status at a U.S. port-of-entry by presenting the required documentation.
Forms required to be submitted for this application
- Form I-129 is only required to extend the TN visa status
Information that you will have to provide
- Proof of citizenship of either Mexico or Canada
- Letter from your prospective employer detailing items such as the professional capacity in which you will work in the United States, the purpose of your employment, your length of stay, and your educational qualifications
- Proof of professional credentials
